This document is the governing agreement between Be Well Church Ministry, its Private Membership Association (collectively "the Ministry" or "Evoke"), and each member who has voluntarily joined. It reflects the full covenant accepted at the time of registration and the legal framework within which the Ministry operates.
This is a reference document. No signature is required here — the binding agreement was entered at signup. In the event of any discrepancy between this page and the agreement you accepted, the original agreement controls.
This document should be read alongside the Ministry Framework, the PMA Reference, and the Privacy Policy. All four documents constitute a coherent framework. This one governs the membership relationship specifically.
Evoke exists to serve the whole person — body, mind, spirit, and community. We gather in the private domain under the protections guaranteed by the Universal Declaration of Human Rights, the Constitution of the United States, Natural Law, and the Law of Nations, to support one another's healing, growth, and collective flourishing.
We hold that all life which grows from the soil is sacred. Access to earth medicine is an inalienable right of every self-determining being. The Ministry's structure — Private Membership Association, integrated auxiliary of a 508(c)(1)(a) church, operating under the Free Exercise Clause and RFRA — exists to protect and honor that right for every member.
This is not a commercial platform. It is a private faith community. Every structural decision — the covenant, the private domain, the sacramental framework — flows from that foundational identity.
3.1 Membership in Evoke constitutes voluntary participation in a private faith community. This relationship is not a commercial transaction. Members are participants in a private religious organization, not customers of a public business.
3.2 Membership is entered voluntarily by each Member and accepted voluntarily by the Ministry. No person is compelled to join. Either party may end the relationship in accordance with Section 18.
3.3 The Ministry reserves the right to decline or discontinue any membership without obligation to provide cause, subject to the principles of good faith that govern this Covenant.
3.4 Membership is personal and non-transferable. It may not be assigned, shared, or inherited. Access credentials are for the registered Member's sole use.
3.5 Membership is open only to individuals who have attained the age of 21 years. By entering this Covenant, each Member affirms they meet this requirement.
Membership in Evoke is an affirmation of alignment with four core beliefs. These are not rules imposed from outside. They are the ground the community stands on. Each Member affirms these commitments at the time of joining.
That healing is possible, that transformation is a right, and that every person carries inherent worth deserving of care. We approach this work with reverence — for the plant, for the practice, for one another.
That your wellbeing and the wellbeing of this community are not separate. What you bring, you share. What we build, we build together. Individual practice and collective flourishing are the same movement.
That the intelligence of nature supersedes manufactured prohibition, and that your body and spirit have sovereignty over themselves. We honor the earth's medicine as sacred and approach it accordingly.
That belief without practice is incomplete. Membership here is an act, not merely a declaration. The covenant is lived through participation, contribution, and presence — not through words alone.
By accepting membership, each Member affirms the following:
By joining Evoke, a Member voluntarily moves from public to private capacity with respect to their activities within this association. This is a meaningful legal distinction, not a formality.
In public capacity, a person is subject to the full reach of state and federal regulatory authority. In private capacity — within a lawfully established private association — a person's activities are a private contractual matter between themselves and the association, operating in the private domain protected by the First Amendment right of association.
This does not mean Members operate outside the law. It means the applicable law is private association law and religious liberty protections, not public commercial regulation. The distinction is documented in the PMA Reference and the Ministry Framework.
The exchange of Tokens for Sacraments in the Apothecary occurs between a Member in private capacity and the Ministry in private capacity. It is a religious contribution within a private faith community — not a retail sale in public commerce. This is not a semantic distinction. It is the legal foundation that makes sacramental access within the Ministry's framework possible.
7.1 Member responsibility. Each Member takes full personal responsibility for their sacramental practice. The Ministry provides Sacraments as tools for sincere religious practice within an intentional context. The Member is responsible for their own physical and psychological suitability, for preparing an appropriate set and setting, and for approaching practice with informed intention.
7.2 No medical claims. The Ministry makes no claim that its Sacraments diagnose, treat, cure, or prevent any disease or medical condition. They are offered as tools for personal and spiritual practice within a sincere religious framework.
7.3 No redistribution. Sacraments are for the Member's personal sacramental use only. They may not be redistributed, gifted, sold, or transferred to any other person, including other Members. Violation of this provision is grounds for immediate termination.
7.4 Jurisdictional responsibility. Members are solely responsible for understanding and complying with the laws of their jurisdiction. The Ministry operates under federal RFRA and Free Exercise protections. State law varies. Members assume full responsibility for their individual jurisdictional compliance.
FDA disclaimer: These statements have not been evaluated by the Food and Drug Administration. The Ministry's Sacraments are not intended to diagnose, treat, cure, or prevent any disease. They are sacramental tools offered within a sincere religious practice framework operated by a private membership association and integrated auxiliary of Be Well Church Ministry.
As a Member of Evoke you retain the following rights within the association:
The right to choose your own path of wellness without interference from the Ministry or other Members. The Ministry supports — it does not direct.
The right to seek and receive counsel from fellow Members on any matter you deem relevant to your life and practice.
The right to participate in association gatherings, community life, and the Ecosystem's features at the level appropriate to your membership.
The right to withdraw from membership at any time of your choosing, in accordance with Section 18.
The right to have your member information held in confidence within the private domain of the association, as described in Section 10 and the Privacy Policy.
The right to access, correct, and request deletion of the personal data the Ministry holds about you, as described in the Privacy Policy.
9.1 Members are expected to engage with the community with honesty, respect, and genuine intention. This is a private faith community — not a social media platform. Conduct standards reflect that character.
9.2 Prohibited conduct. The following are grounds for immediate suspension or termination:
9.3 The Ministry reserves the right to moderate content, suspend posting privileges, or remove content that does not meet community standards, at the Ministry's sole discretion.
What is shared within Evoke stays within Evoke. This community is a protected space. Each Member agrees to protect it for others as they expect it to be protected for themselves.
10.1 Member obligation. Members agree to hold in confidence all information about other Members — including identity, membership status, participation history, personal disclosures made within community forums, and any information shared in private communications within the platform.
10.2 Ministry obligation. The Ministry agrees to hold Member records in confidence within the private domain of the association. Member information will not be disclosed to external parties except as required by a valid legal process directed to the Ministry and consistent with the Ministry's constitutional protections.
10.3 Survival. Confidentiality obligations survive the termination of membership. Former Members remain bound by this Section with respect to information obtained during active membership.
Evoke welcomes all people. We do not exclude by race, background, belief system, or profession — including those employed in law enforcement or government agencies. We are a healing community. We state what follows not from fear, but from clarity.
11.1 Bad faith entry defined. Any person who enters this association with intent to surveill, gather evidence against Members or the Ministry, disrupt operations, or bring harm to members, affiliates, or the association itself — regardless of stated identity or profession — is entering in bad faith. Bad faith entry constitutes intentional trespass on the private property and privacy of this association and its Members.
By completing membership, any person entering in bad faith acknowledges and agrees that such trespass creates immediate financial liability of $2,000,000, plus $100 per minute for the duration of the trespass. This liability is enforceable through private arbitration under the dispute resolution terms of Section 17.
This provision applies regardless of whether the individual's stated identity or purpose was disclosed at the time of joining. The binding nature of this agreement extends to the act of entry itself, regardless of any claim of authority or legal mandate by the entering party.
11.2 Sincere welcome. This provision does not diminish the Ministry's sincere welcome to all persons approaching in good faith. Law enforcement personnel, government employees, journalists, and researchers who join with genuine personal interest in the community's practices are welcome on the same terms as any other Member.
Evoke supports each Member's journey. It does not direct, prescribe, or assume responsibility for it. Each Member is the authority over their own body, mind, and spirit.
12.1 Each Member affirms that they are a self-determining individual who accepts full and sole responsibility for their choices — including any choices related to wellness practices, sacramental use, or guidance received within this community.
12.2 Each Member affirms that they have entered this association as a legal adult of their own free and informed will, without coercion, and with genuine understanding of the nature of the community they are joining.
12.3 Personal sovereignty is both a right and a responsibility within this community. The right to self-determination is accompanied by the responsibility to exercise it with care — for oneself and for the community that extends the same protection to every Member.
The Ministry's complete data practices are described in the Privacy Policy. The following summarizes the key terms as they relate to membership.
13.1 We collect only what you provide. Your legal name is not required. You may use any name you choose.
13.2 Payment credentials are never stored on Ministry servers. Billing is processed entirely by our payment processors.
13.3 Member records are held within the private domain of the association and are not subject to public disclosure requirements applicable to commercial businesses.
13.4 We do not sell, license, or share your data with third parties for commercial purposes.
13.5 You may access, correct, and request deletion of your personal data at any time by contacting [email protected].
14.1 All Ministry content — formulation specifications, educational materials, publications, research protocols, and platform design — is the intellectual property of Be Well Church Ministry. Members are granted a personal, non-transferable license to access and use this content for their own participation. No other use is permitted without written authorization.
14.2 Content Members post within community spaces remains the Member's own. By posting, Members grant the Ministry a non-exclusive license to display that content within the community. The Ministry will not reproduce Member content externally without consent.
14.3 The Ministry's extraction methodology, botanical biasing protocols, and honey carrier matrix system are proprietary. Members may not reproduce, reverse engineer, or disclose these methods to third parties.
14.4 Evoke, Be Well Church Ministry, Be Wellness Ecosystem, and associated marks are the property of the Ministry. Members may not use these marks commercially without written authorization.
15.1 Nothing in the Ministry's content, communications, coaching, or sacramental protocols constitutes medical advice. The Ministry is not a healthcare provider. Members with pre-existing medical or psychiatric conditions, those taking medications, or those who are pregnant or nursing should consult a qualified healthcare provider before any sacramental practice.
15.2 The Ministry's reference documents describing its legal framework are provided for Member education and reference. They do not constitute legal advice and do not create an attorney-client relationship.
15.3 The effects of sacramental practice vary significantly between individuals. The Ministry's dose tier descriptions are general guidance. Members assume full responsibility for their individual responses.
15.4 The Ministry does not warrant that the platform will be available without interruption or error.
16.1 To the fullest extent permitted by applicable law, the Ministry, its principals, staff, coaches, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from a Member's participation in the Ecosystem, use of Sacraments, or reliance on Ministry content.
16.2 Members acknowledge that sacramental practice involving psychoactive botanical compounds carries inherent risks, including psychological distress, triggering of latent psychiatric conditions, adverse physical reactions, and legal risk in certain jurisdictions. Members assume these risks voluntarily and in full awareness.
16.3 The Ministry's aggregate liability to any Member shall not exceed the total amount of charitable contributions made by that Member in the twelve months preceding the event giving rise to the claim.
17.1 Any dispute arising from this Covenant, membership, or any transaction within the Ecosystem shall be resolved through binding private mediation. Members waive the right to litigate covered disputes in public courts.
17.2 Resolution is sought first through good faith conversation, then through association-appointed mediation if needed. Written notice to [email protected] initiates the formal process. Parties will agree on a mediator within 30 days of notice.
17.3 The bad faith entry liability described in Section 11 is enforceable through this private arbitration mechanism.
17.4 Members waive the right to participate in any class action or collective proceeding against the Ministry. All disputes are individual.
17.5 Nothing in this Section prevents either party from seeking emergency injunctive relief where immediate irreparable harm would otherwise result.
18.1 By the Member. A Member may terminate at any time by written notice to [email protected]. Termination takes effect within seven days. Token and Points balances are forfeited. Contributions are non-refundable.
18.2 By the Ministry. The Ministry may terminate any membership at any time with seven days written notice. Termination for cause — including violation of Section 9 — may take effect immediately.
18.3 Upon termination, all access to the Ecosystem and Apothecary ceases. Confidentiality and dispute resolution obligations survive termination.
The following apply to all visitors to evokemagic.org and community.evokemagic.org, including non-members accessing public content.
19.1 You may access the Ministry's public websites for lawful purposes only. You may not scrape, crawl, or systematically extract content; attempt to circumvent security measures; or use the sites for any unauthorized commercial purpose.
19.2 The Ministry's websites may contain links to third-party sites. The Ministry does not endorse or take responsibility for third-party content.
19.3 The websites use essential cookies to maintain session state. Analytics cookies may be used in aggregate and anonymized form. No advertising cookies are used.
19.4 The Ministry's websites are provided on an "as is" basis for informational purposes only.
19.5 DMCA. Copyright infringement notices should be sent to [email protected] with identification of the work claimed to be infringed, the infringing material's location, contact information, a statement of good faith belief, and a statement under penalty of perjury that the information is accurate.
20.1 This Covenant is governed by the principles of natural law and private contract, interpreted in light of the constitutional protections applicable to private religious associations under the First and Fourteenth Amendments and RFRA.
20.2 Severability. If any provision is found unenforceable, remaining provisions continue in full force. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving the parties' intent.
20.3 Entire agreement. This Covenant, together with the Privacy Policy and any supplemental terms presented at the time of a specific transaction, constitutes the entire agreement between the Member and the Ministry. It supersedes all prior representations and understandings.
20.4 Amendments. The Ministry may amend this Covenant at any time with reasonable advance notice. Continued participation following notice constitutes acceptance. Members who do not accept an amendment may terminate in accordance with Section 18.1.
